Guerilla Creative Marketing, Inc., doing business as Guerilla Staffing Solutions, is referred to in these Terms and Conditions as the “Company.”
These Terms and Conditions govern your use of the Company’s application process through Manatal or any other recruitment channel used by the Company. By submitting your application, resume, profile, interview responses, assessment results, supporting documents, or any related information, you confirm that you have read, understood, and agreed to these Terms and Conditions.
Purpose of the Application Process
The Company collects and reviews applicant information to assess qualifications for current or future job opportunities, communicate with applicants, verify information relevant to candidacy, maintain an internal talent pool, and meet legal, regulatory, audit, and operational requirements. Submission of an application does not guarantee interview progression, client endorsement, employment, or placement.
Accuracy of Information
You agree that all information you provide is true, complete, accurate, and current. You must not submit false, misleading, incomplete, altered, falsified, or unauthorized information, including resumes, certificates, identification documents, employment records, compensation records, educational records, or any supporting document that is inaccurate or belongs to another person without proper authority. The Company may reject your application, remove your profile from its database, or discontinue your candidacy if any submitted information is found to be false, misleading, incomplete, or unverifiable.
Applicant Responsibility
You are responsible for ensuring that your contact details are active and correct, responding to recruitment communications within a reasonable time, attending interviews, assessments, and meetings as scheduled unless properly rescheduled, providing documents or clarification reasonably requested during the hiring process, and keeping your account credentials secure where applicable. Failure to respond, failure to attend scheduled recruitment activities, repeated no-shows, unprofessional conduct, or failure to provide requested documents may affect your application status.
Lawful and Proper Use
You agree to use the application platform and recruitment process only for lawful purposes. You must not upload harmful, offensive, unlawful, defamatory, obscene, discriminatory, or fraudulent content, attempt to gain unauthorized access to systems, accounts, or records, interfere with the security or functionality of the recruitment platform, copy, scrape, harvest, or misuse job listings, recruiter communications, applicant data, or platform content without authorization, or use bots, scripts, or automated tools to manipulate application activity unless expressly authorized.
Confidentiality and Recruitment Materials
Any non-public information shared with you during the recruitment process must be treated as confidential, including client names, job details, salary structures, assessment materials, interview questions, internal documents, recruitment communications, and business or operational information. You must not disclose, copy, record, reproduce, publish, or share confidential recruitment information without prior written consent from the Company.
Background Checks and Verification
Where allowed by law and relevant to the role, the Company may verify the information you provide, including identity, employment history, educational background, certifications, licenses, references, work eligibility, compensation history where lawful, and publicly available professional information. By proceeding with your application, you authorize the Company to conduct reasonable pre-employment verification and to request supporting documents where necessary.
Client Endorsement and Matching
The Company may endorse your profile to internal hiring teams, affiliates, or clients when your qualifications appear relevant to an open role. Endorsement is at the sole discretion of the Company, and the Company may choose not to endorse, pause, or withdraw endorsement at any stage. A client interview or endorsement does not create an employment contract.
Intellectual Property
Any forms, materials, content, branding, workflows, notices, assessment formats, and documents used in the recruitment process remain the property of the Company, its clients, licensors, or partners, as applicable. You may use these materials only for your personal application purposes and must not reproduce, distribute, modify, sell, or commercially exploit them without prior written consent.
No Employment Guarantee
Your submission of an application does not create an employer-employee relationship, contractor relationship, partnership, agency relationship, or guaranteed right to be hired, interviewed, endorsed, or retained in a talent pool. Any hiring decision will depend on company standards, client requirements, screening results, business needs, and applicable law.
Disqualification and Removal
The Company may suspend, restrict, reject, or remove your application or profile at any time for legitimate business or legal reasons, including suspected fraud, misrepresentation, inappropriate or abusive behavior, breach of confidentiality, failure to follow recruitment instructions, submission of prohibited content, or conflict with legal or regulatory obligations.
Communications Consent
By applying, you consent to receive recruitment-related communications through available channels, including email, phone, SMS, messaging apps, and platform notifications, for application updates, interview scheduling, verification, future role matching, and other recruitment purposes, subject to your communication preferences and applicable law.
Data Privacy
Your personal data will be collected, used, stored, shared, retained, and disposed of in accordance with the Company’s Applicant Privacy Policy and applicable data privacy laws. By applying, you acknowledge that you have read and understood the Applicant Privacy Policy.
Limitation of Liability
To the extent allowed by law, the Company will not be liable for losses caused by inaccurate submissions, missed opportunities resulting from failure to respond or attend scheduled activities, service interruptions or technical issues caused by third-party systems, or indirect, incidental, or consequential damages arising from your use of the recruitment platform or participation in the hiring process.
Governing Law
These Terms and Conditions are governed by the laws of the Republic of the Philippines, and any dispute arising from the application process shall be handled in accordance with applicable Philippine law.
