Terms And Conditions for Referral Programs

Guerilla Creative Marketing, Inc., doing business as Guerilla Staffing Solutions, is referred to in these Terms and Conditions as the “Company.”

These Terms and Conditions govern the submission of candidate referrals to the Company through Manatal or any other recruitment channel approved by the Company. By submitting a referral, you confirm that you have read, understood, and agreed to these Terms and Conditions.

Purpose of the Referral Process

The referral process allows employees, contractors, partners, or other authorized individuals to recommend potential candidates for current or future opportunities with the Company. Submission of a referral does not guarantee candidate contact, screening, endorsement, interview, hire, or referral incentive unless covered by a separate written referral incentive policy.

Consent of the Referred Candidate

You may only submit a referral if you have the referred person’s permission to share their personal data with the Company for recruitment purposes. By submitting a referral, you confirm that the referred candidate knows their information will be shared, has agreed to be contacted for recruitment purposes, and that the information you provide is accurate to the best of your knowledge.

Information You May Submit

You should provide only information reasonably necessary for referral and recruitment purposes, such as the candidate’s full name, contact details, resume or profile link, current or most recent role, relevant skills or qualifications, your relationship to the candidate, and the job opening or department if applicable. You must not submit excessive, irrelevant, confidential, defamatory, sensitive, or unauthorized information about the referred person.

Accuracy and Lawful Conduct

You agree not to submit false, misleading, or incomplete referral information, impersonate another person, refer fictitious candidates, submit duplicate referrals in bad faith, misrepresent your relationship with the candidate, or provide information that violates privacy, intellectual property, or other legal rights. The Company may reject or remove any referral that appears improper, unauthorized, incomplete, duplicate, abusive, or inconsistent with company policy.

Ownership and Use of Referral Information

All referral records, notes, processing history, and recruitment actions relating to a submitted referral will be maintained by the Company as part of its recruitment records, subject to applicable privacy laws and internal policy.

Review and Processing of Referrals

The Company has sole discretion to evaluate whether a referral meets hiring needs, contact or not contact the referred person, request additional information, determine whether a referral overlaps with an existing candidate profile or prior application, and decide whether a referral is valid for internal tracking or incentive purposes. If the referred person already exists in the recruitment database, is already in process, or was previously endorsed through another source, the referral may be treated as duplicate or ineligible under internal rules.

Referral Incentives

Any referral incentive, bonus, reward, or recognition will be governed strictly by a separate written referral program policy, if one exists. Unless expressly stated in a separate written policy, submission of a referral does not create any entitlement to payment, reward, commission, reimbursement, or employment-related benefit.

Privacy and Data Protection

Referral information and referred candidate data will be handled in accordance with the Company’s Applicant Privacy Policy and applicable law. By submitting a referral, you acknowledge that you have authority to share the candidate’s information for referral purposes, the candidate has been informed about the referral, and the candidate’s personal data may be processed by the Company for recruitment evaluation, communication, verification, and future talent pooling, subject to applicable law.

Confidentiality

You must keep confidential any non-public information you may receive about job openings, client needs, hiring decisions, candidate status, interview feedback, recruitment actions, or internal referral discussions. You must not disclose a candidate’s recruitment status, interview outcome, assessment result, or hiring decision unless you are authorized to receive and share that information.

No Guarantee of Hire or Status Update

The Company does not guarantee that the referred person will be contacted, that the referrer will receive updates on the candidate’s application, that the candidate will be interviewed or hired, or that the referrer will receive detailed feedback or confidential hiring information. To protect privacy, the Company may limit the information shared with the referrer regarding the referred candidate’s application status.

Disqualification of Referral

The Company may disqualify a referral if the candidate did not consent, the referral contains false or misleading information, the candidate is already in process or already known to the Company, the referrer attempted to manipulate the process, or the referral violates law, privacy obligations, or company policy.

Limitation of Liability

To the extent allowed by law, the Company will not be liable for any indirect, incidental, or consequential loss arising from submission or non-acceptance of a referral, non-selection of a referred candidate, failure to qualify for any incentive, delays or technical issues, or actions taken based on inaccurate information submitted by the referrer.

Governing Law

These Terms and Conditions are governed by the laws of the Republic of the Philippines, and any dispute relating to the referral process shall be handled in accordance with applicable Philippine law.
