1. Introduction These Application Terms & Conditions ("Terms") govern the application process at HANALYTICA GmbH and its affiliated entities ("HANALYTICA", "we", "us", or "our"). By submitting an application on our website or through any other platform provided by us, you agree to these Terms.
2. Accurate and Complete Information By applying for a position with our company, you agree to provide accurate and complete information in your application, resume, and any other supporting documentation. You acknowledge that any false, misleading, or incomplete information may disqualify you from consideration for employment or result in termination of employment if discovered after hire.
3. Authorization for Background Checks You authorize our company to conduct a background check, which may include a criminal record check, educational verification, employment verification, OFAC verification, sex offender check, ID check and/or passport check.
4. Collection and Processing of Personal Data We collect and process your personal data, including your name, contact information, employment history, education, and other relevant information, for the purpose of evaluating your application, conducting background checks, and communicating with you during the recruitment process.
5. Compliance with Data Protection Laws You acknowledge that our company is required to comply with applicable data protection laws, including the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA), the California Consumer Privacy Act (CCPA), and the General Data Protection Regulation (GDPR). We will handle your personal data in accordance with our privacy policy.

Recording and Transcription of Interviews You understand and agree that our company may record and transcribe your interviews with us for the purpose of improving our hiring processes and training our staff. These recordings and transcriptions will be handled in accordance with our privacy policy and applicable data protection laws, including PIPEDA, CCPA, and GDPR.
8. Employment At-Will You understand that employment with our company is at-will and may be terminated at any time, with or without cause or notice, at the discretion of our company or you.
9. Compliance with Company Policies If hired, you agree to abide by all company policies and procedures, as well as any applicable laws and regulations.
10. Amendments to These Terms You acknowledge that our company may change these Terms at any time and that your continued application to our company indicates your acceptance of any such changes.
11. Dispute Resolution You agree that any dispute arising out of or related to your application or employment with our company will be resolved through binding arbitration, in accordance with the rules and procedures of the American Arbitration Association.
12. Entire Agreement You acknowledge that these Terms constitute the entire agreement between you and our company with respect to your application and employment, and that any other representations, promises, or agreements are superseded by these Terms.
13. Governing Law and Jurisdiction These Terms are governed by and construed in accordance with the laws of the Republic of Austria. The exclusive jurisdiction for any disputes arising out of or in connection with these Terms shall be in Linz, Austria.
