Information Collection
LAK CONSULTING GROUP collects a range of personal information about you as a job applicant. This information includes (i) your personal contact information such as name, address, email, telephone numbers, Skype ID, WhatsApp number, (ii) details of your qualifications, skills, experience, and employment history including exam results and licensure information, competency and language exam information, (iii) information supplied by your CV, interviews, and references, (iv) information about your entitlement to work in Germany, other EU countries, Switzerland, the UK or any other country including gender, date of birth, country of birth, passport information, photo and visa information, (v) if your spouse andor family will come with you to the above mentioned countries, information about your marital and family status and information about your spouse’s andor family’s immigration status including name, gender, date of birth, country of birth, passport information, photo and visa information.
LAK CONSULTING GROUP may further collect personal information about you as a prospective employee including (i) information necessary to enter into an employment contract such as job title and duties, compensation and benefits information, terms and conditions of employment, tax and banking details related to payroll, type and duration of employment, probationary period, and other information necessary to perform the terms of an employment contract. (ii) business site or location, work schedule, job assignments, promotions and transfers, job performance, awards and accomplishments, training and development information, emergency contacts, photographic image, skills, talents, and career goals; appraisal ratings, hours worked and attendance; employee policy acknowledgments, position profile data, vacancies, and geographic indicators to fulfil the legitimate interests in managing the employment relationship, (iii) education information, driving qualifications, information on taking exams, (iv) and information from clients regarding the job assignment process.
LAK CONSULTING GROUP collects this personal information through (i) application forms, (ii) CVs, (iii) passport or other identity documents, (iv) certificates, (v) and interviews or other forms of assessment.
LAK CONSULTING GROUP may also collect personal data about you from third parties, such as references supplied by former employers, information from licensing authorities or testing providers, and job assignment information from clients.
Information Usage
Your personal information will be stored in a range of different places, including on your application record, in HR management systems and on other IT systems including email.
LAK CONSULTING GROUP needs to process personal information to (i) take steps at your request prior to entering into a contract with you, (ii) process your data to enter into a contract with you, (iii) process personal information to ensure that it is complying with its legal obligations, (iv) to check and facilitate successful applicant’s eligibility to work in Germany, other EU countries, Switzerland, the UK or any other country before employment commences.
LAK CONSULTING GROUP has a legitimate interest in processing personal data during the recruitment and hiring process and for keeping records of the process. Processing data from applicants allows us to manage the recruitment, hiring, and client job assignment process, assess and confirm a candidate’s suitability for employment, decide to whom to offer a job, and decide which client to assign the applicant. We may also need to process data from applicants to respond to and defend against legal claims.
LAK CONSULTING GROUP will not use your data for any purpose other than the recruitment, hiring, and placement process for which you have applied.
Information Access
Your information may be shared internally for the purposes of the recruitment, hiring, and job assignment process. This includes members of the LAK CONSULTING GROUP human resource and recruitment team, interviewers involved in the recruitment process, managers in the business area with a vacancy and IT staff if access to the data is necessary for the performance of their roles.
LAK CONSULTING GROUP also shares personal data with third party suppliers such as payroll companies to pay our employees and database application providers for recruitment purposes. Further, we share personal information with former employers to obtain references for you, immigration authorities for visa purposes, licensing authorities and testing providers for qualification purposes, and clients for job assignment.
Security
LAK CONSULTING GROUP has implemented generally accepted standards of technology and operational security to protect personal information from loss, misuse, alteration, or destruction.
Only authorized employees and contractors have limited access by need to any information provided by you and are required to maintain its confidentiality.
Despite these precautions however, LAK CONSULTING GROUP cannot guarantee that unauthorized persons will not obtain access to your personal data and LAK CONSULTING GROUP cannot be responsible for any actions resulting from a breach of security when information is supplied over the internet or any public computer network.
Information Storage
If your application for employment is unsuccessful, LAK CONSULTING GROUP will hold your data on file for 12 months after the end of the relevant recruitment process. Before the end of that period LAK CONSULTING GROUP will contact you to update or delete your data. If you agree to update your data, you allow LAK CONSULTING GROUP to keep your personal data on file for a further 12 months for consideration for future employment opportunities. Before the end of that period LAK CONSULTING GROUP will contact you again to update or delete your data.
If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your personnel file and retained during your employment and kept in accordance with applicable data retention laws or for the time necessary to comply with legal obligations or to establish, exercise or defend legal claims.
EU Residents
EU residents have the right to (i) access and obtain a copy of your personal information on request, (ii) require LAK CONSULTING GROUP to change incorrect or incomplete data, (iii) require LAK CONSULTING GROUP to delete or stop processing your personal information, (iv) and object to the processing of your personal information data where LAK CONSULTING GROUP is relying on its legitimate interests as the legal ground for processing.
Data Transfers
Due to our international operations, personal information collected may be transferred to other LAK CONSULTING GROUP offices to process your application.
You are under no statutory or contractual obligation to provide data to LAK CONSULTING GROUP during the recruitment and employment contract. However, the international transfer of your personal information is necessary to perform your employment contract. If you do not provide the information, LAK CONSULTING GROUP may not be able to process your application or enter into an employment agreement with you.
