These are the Terms of Use (“Terms”) for LAK CONSULTING GROUP and its subsidiaries and affiliates (collectively, “LAK CONSULTING GROUP”, “us”, “our” or “we”).

Please read this Terms carefully before accessing, browsing, or otherwise using the information and services available through any website that states these Terms of Use (collectively, “the Site”). Your access to, and browsing, review and use of the Site is subject to these Terms of Use and all applicable laws. By accessing and using the Site and our services or registering with LAK CONSULTING GROUP or submitting your information or application to LAK CONSULTING GROUP you accept these Terms of Use, without limitation or qualification. If you do not agree to the Terms of Use, do not use the Site. If, at any time, any part of these Terms is no longer acceptable to you, immediately terminate your use of the Site.

Copyright, Trademarks and Use of Sites

This Site and all the information it contains, or may in the future contain, including, but not limited to, articles, memoranda, bulletins, reports, press releases, opinions, text, directories, guides, photographs, illustrations, trademarks, trade names, service marks and logos (collectively, the “Content”), is the property of LAK CONSULTING GROUP, and is protected from unauthorized copying and dissemination by copyright law, trademark law, international conventions, and other intellectual property laws.

Certain of the trademarks and logos displayed on the Site are owned by third parties. Except as we have described in these Terms of Use, nothing contained on this Site should be construed as granting, by implication, or otherwise, any license or right to use this Site or any Content displayed on this Site, through the use of framing or otherwise, without the prior written permission of LAK CONSULTING GROUP or such third party that may own the trademark or copyright of material displayed on this Site.

LAK CONSULTING GROUP encourages and permits links to Content on the Site. However, LAK CONSULTING GROUP is an organization committed to the highest professional standards. Therefore, we do not grant any license or other permission for links or other use of the Site or its Content if such use or link (i) suggests that LAK CONSULTING GROUP promotes or endorses any third party’s causes, ideas, political campaigns, websites, products or services, (ii) copies, displays, disseminates or otherwise uses the Content without LAK CONSULTING GROUP written consent, or (iii) uses the Content for commercial purposes.

Furthermore, LAK CONSULTING GROUP does not grant its consent for links to the Site where the linking party engages in any Prohibited Conduct (as described in these Terms of Use). We reserve the right to withdraw permission for any link at any time.

Subject to your full compliance with these terms, LAK CONSULTING GROUP authorizes you to view the Content, make a single copy of it, and print that copy, but only for your own lawful, personal, non-commercial use, provided that you maintain all copyright, trademark and other intellectual property notices contained in such Content, and provided that the Content, or any part thereof, is not modified.

If LAK CONSULTING GROUP permits you to advertise on the Site you grant LAK CONSULTING GROUP an irrevocable, permanent and royalty free licence to use any advertisement that has been submitted by you for placement on the Site or any other third-party website deemed reasonable by LAK CONSULTING GROUP for the purpose of generating user views and applications. You may not and must not allow or permit other parties on your behalf to copy advertisements, or to undertake site scraping or other similar activities unless you have obtained the prior written permission of LAK CONSULTING GROUP.

If you choose to provide LAK CONSULTING GROUP with personal information as part of your use of the Sites, this information will be managed in accordance with our Privacy Statement and Applicant Privacy Statement. Please read our Privacy Statement and Applicant Privacy Statement before using the Site.

Acceptable Use

You agree that during your use of the Sites you will not intentionally make representations that are misleading or false. Your use of the Sites shall be for personal or professional purposes only and you will not use the Site to store, send, distribute, or publish any offensive information or unsolicited contact.

Prohibited Conduct

You may use the Site for lawful purposes only. You may not upload to, or distribute or otherwise publish through the Site, any Content that is (i) libellous, defamatory, obscene, pornographic, abusive, racist, sexist, harassing or threatening, or otherwise objectionable to LAK CONSULTING GROUP in our sole discretion, (ii) contains computer viruses, worms, moles or other contaminating or destructive elements, (iii) violates the rights of others, such as Content that infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity, (iv) contains any false or misleading statement, (v) contains advertising; or (vi) otherwise violates any applicable criminal or civil law. You may not use the Site for any commercial purpose and may not distribute over the Site any solicitation of funds, goods and services. Furthermore, you may not use the Site to solicit subscribers to join other online information services that are competitive with the Site.

Third Parties

LAK CONSULTING GROUP may provide you with links to third party websites, and some of the Content appearing to originate from the Site may be supplied by third party Content providers. LAK CONSULTING GROUP has no responsibility for these third-party websites, which are governed by the terms of use and privacy policies, if any, of the applicable third-party Content providers.

You acknowledge that LAK CONSULTING GROUP is not responsible for the availability of, or the content or software applications located on or through any external Site.

Access and Availability

LAK CONSULTING GROUP gives no guarantee as to the availability and performance of the Site. Accordingly, the Site is provided by LAK CONSULTING GROUP on an ‘as and when available’ basis. The Site may become unavailable as a result of maintenance, malfunction of computer hardware or software, or for other reasons, and may result in damages to your systems or operations. You shall be solely responsible for ensuring that any information or Content obtained from the Site does not contain any virus, worm, mole or other computer software code or subroutine designed to disable, erase, impair or otherwise damage your systems, software, or data.

Where the Site provides links to external websites maintained by third parties, LAK CONSULTING GROUP gives no guarantee or endorsement as to the services operated by those websites.

Security

While LAK CONSULTING GROUP takes reasonable steps to ensure that information provided to us by users via the Site is maintained securely, and in accordance with our Privacy Statement and Applicant Privacy Statement, we accept no responsibility for breaches of security or unauthorized access that arise as a result of disclosure by Users of their login details, username or password. You will remain responsible, at all times, for maintaining the confidentiality of your login details, username and password and LAK CONSULTING GROUP accepts no liability for the misuse of these details.

LAK CONSULTING GROUP also takes reasonable steps to ensure the Site is virus free. By using the Site, you acknowledge that accessing the Site is done at your own risk. This also includes, but is not restricted to, any monetary or other loss that may result from loss or corruption of data, downtime, or hardware damage.

Content Management and Removal

LAK CONSULTING GROUP does not and cannot review generally the content posted by users of the Site (“Users’ Content”) and is not responsible for such Users’ Content.

LAK CONSULTING GROUP does not represent or endorse the accuracy or reliability of any Users’ Content displayed, uploaded, posted on any message board, or otherwise distributed through the Site by any subscriber, information provider or any other third party.

However, we reserve the right to cancel your access to these areas and/or delete, move, or edit any Users’ Content (including messages posted in any forum) that it may determine, in its sole discretion, violates the Terms of Use. You shall remain solely responsible for all Users’ Content posted by you or by any other person using your account. LAK CONSULTING GROUP expressly disclaims any liability related to Users’ Content, and you acknowledge that any reliance upon such Subscriber Content shall be at your sole risk. LAK CONSULTING GROUP shall have the right, but not the obligation, to correct any errors or omissions in any Users’ Content, as it may determine in its sole discretion.

LAK CONSULTING GROUP prohibits the posting of any information that infringes or violates the copyright rights and or other intellectual property rights, including rights of privacy and publicity, of any person or entity. If you believe that your intellectual property right, or such a right that you are responsible for enforcing is infringed by any content on the Site, please write to LAK CONSULTING GROUP, giving a written statement that contains (i) an identification of the copyrighted work and or intellectual property right claimed to have been infringed, (ii) an identification of the allegedly infringing material on the Site that is requested to be removed, (iii) your name, address, contact number and e-mail address, (iv) a statement that you have a good faith belief that the use of the copyrighted work and/or exercise of the intellectual property right is not authorized by the owner, its agent, or the law, (v) a statement that the information in the notification is accurate, and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of the right that is allegedly infringed, and (vi) the signature of the intellectual property right owner or someone authorized on the owner’s behalf to assert infringement of the right. LAK CONSULTING GROUP will remove any posted submission that infringes the copyright or other intellectual property right of any person upon receipt of such a statement.

Persons who repeatedly submit infringing or unlawful material will be prohibited from posting further submissions.

Restriction, Suspension, Termination

LAK CONSULTING GROUP reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the Site at any time for any reason without prior notice or liability and without any obligation to refund any portion of fees paid for any product or service.

LAK CONSULTING GROUP may change, suspend, or discontinue all or any aspect of the Site at any time, including the availability of any Site feature, database, or content, without prior notice or liability.

LAK CONSULTING GROUP reserves the right to suspend or close accounts at its absolute discretion in the event of, but not limited to, non-payment of advertisements or breaches of these Terms of Use.

LAK CONSULTING GROUP retains the right to refuse, withdraw or require to be amended any information submitted via the Site, or any advertisement placed on the Site, that LAK CONSULTING GROUP deems to be illegal, misleading, offensive or in any other way unsuitable.

Online Requests

LAK CONSULTING GROUP may offer to provide information or materials via e-mail or otherwise to interested persons. LAK CONSULTING GROUP reserves the right, in its absolute discretion, to reject any requests for such information or materials, or to discontinue the provision of such information or materials to any person, for any reason whatsoever.

Subscriber Qualification

When registering with or applying to LAK CONSULTING GROUP you must provide accurate, complete, and current registration information and you agree to provide LAK CONSULTING GROUP with any updates to that information promptly after such changes occur.

This Site is not designed for and does not intentionally target or solicit to children. Individual subscriptions to the Site are available only to persons who are at least 18 years of age or at least the age of majority in the jurisdiction of residence.

Your right to use the Site is personal to you and cannot be transferred to any other person.

You shall be responsible for obtaining communication services, computer equipment and other products or services necessary to access and use the Site. You shall further be responsible for all charges associated with accessing and maintaining a connection to the Site including, but not limited to, charges imposed by an internet service provider, or your local telephone company.

Job Advertisements

LAK CONSULTING GROUP provides no guarantee as to the accuracy or availability of any specific job that may be advertised on the Site. You should be aware that parties that advertise on the Site may have already filled the position in an advertisement even though it still appears on the Site.

LAK CONSULTING GROUP also cannot guarantee that any advertisement placed on the Site will attract applications from Users, or that any advertisement placed on the Site will lead to the placement of a successful candidate in an advertised position.

Payment and invoice terms for placement of job advertisements or other services will be made according to the terms specified in the agreement LAK CONSULTING GROUP enters with you in relation to our services.

If you submit an advertisement to be placed on the Site, you agree to pay LAK CONSULTING GROUP in full for that advertisement prior to its publication on the Site. LAK CONSULTING GROUP will not pay any refunds under any circumstances.

Advertisers

Advertisers agree that (i) they will only list one job position per advertisement unless otherwise agreed. LAK CONSULTING GROUP reserves the right to individually charge for any multi-job listings that appear within the same advertisement. LAK CONSULTING GROUP also reserves the right to remove any advertisements that are in breach of this policy (ii) they will not perform any refresh or reposting of advertisements purely for the purpose of restoring those ads to the top of any search listings. (iii) unless otherwise agreed, they will only include branding on the Sites that represents the entity with whom LAK CONSULTING GROUP has a contractual arrangement. (iv) unless otherwise agreed, they will only have branding representation on the Sites in the categories in which they post job content in a calendar month. (v) they may only use an external application link where this link directly takes the applicant to a definitive application form. (vi) unless otherwise agreed, the only means of contact with the advertiser that will be communicated in a job advertisement are those available through the Sites application process and other provided system contact points. All other contact information (such as phone numbers, email addresses etc) which bypasses the Sites and is not able to be tracked or is not being tracked by LAK CONSULTING GROUP will be deemed as unacceptable.

Recruitment of Candidates

LAK CONSULTING GROUP confirms it has access to prospective Third Parties who, if all the requirements for the agreement between the Third Party and the Candidate have been met, may result in an appointment in the position (herein referred to as “Employment Relationship”) in terms of such conditions that may apply during the proposed future conclusion of the Employment Agreement between the Third Party and the Candidate (herein referred to as “Service”).

LAK CONSULTING GROUP cannot guarantee to find a suitable placement at the Third Party, including compensation and payment, for the Candidate. The decision to work at the Third Party rests solely with the Candidate.

The Candidate hereby voluntarily presents himself/herself to be available to be appointed in a position at a Third Party and exclusively at the Third Party with the total exclusion of LAK CONSULTING GROUP.The Candidate shall present LAK CONSULTING GROUP with such information as may be requested on the sole discretion of LAK CONSULTING GROUP and the Candidate consents to the utilization and publication of any and all such information presented by the Candidate to LAK CONSULTING GROUP, to be used and revealed to the Third Party. LAK CONSULTING GROUP may present any and all such information presented by the Candidate to the Third Party.

LAK CONSULTING GROUP shall advise the Candidate should the Third Party be interested to engage with the Candidate to be appointed into the position by presenting the Candidate with an offer to be appointed by the Third Party.

The Candidate shall be requested to accept such offer that shall result that the Candidate and the Third Party has reached a binding contract to be appointed in the position, with the exclusion of LAK CONSULTING GROUP to any of such terms of the contract to be appointed in the position.

Recruitment Fees and Terms of Payment

LAK CONSULTING GROUP records that it has entered into an undisclosed agency fee agreement with the Third Party, of which the Candidate is not a party to, save for referring to the Candidate in terms of the agreement and the Candidate has no claim against LAK CONSULTING GROUP for any payment in terms of LAK CONSULTING GROUP fee agreement between LAK CONSULTING GROUP and the Third Party.

LAK CONSULTING GROUP and the Candidate record that LAK CONSULTING GROUP did not receive any payment of any amount in the form of a fee from The Candidate for performing the service.

Should LAK CONSULTING GROUP and the Candidate enter into an undisclosed financing agreement to enable the Candidate to achieve necessary requirements to enter the Employment Relationship the Third Party has no claim against LAK CONSULTING GROUP for any payment in terms of LAK CONSULTING GROUP fee agreement between LAK CONSULTING GROUP and the Candidate.

Candidates Confidentiality

Except as may be otherwise required by law, LAK CONSULTING GROUP will exercise reasonable efforts to ensure that the Candidate’s information remains confidential and is available only to personnel who have a need to know such information in connection with providing the Candidate with LAK CONSULTING GROUP’s services or general business purposes.

LAK CONSULTING GROUP will not sell the Candidate’s name, address or similar personally identifying information to unrelated third parties or permit the use of such information outside the scope of LAK CONSULTING GROUP’s service or general business purposes.

The Candidate shall not contact the Third Party directly for any reason prior to reporting for the position, without LAK CONSULTING GROUP prior written consent.

Liability

You agree that LAK CONSULTING GROUP will not be liable for any damages or liability whatsoever that may arise as a result of your use of the Sites or other services. LAK CONSULTING GROUP hereby also exclude any warranties as to the accuracy, quality and validity of any of the Sites contents, including CVs or other information submitted by Users of the Sites in response to advertisements.

Indemnification

You will at all times indemnify and will continue to indemnify, hold harmless and defend LAK CONSULTING GROUP, and all of its predecessors, successors, parents, subsidiaries, affiliates, and past and present officers, directors, shareholders, investors, employees, agents, information providers, attorneys, representatives licensors and information providers (collectively, the “LAK CONSULTING GROUP Representatives”) harmless from and against any and all liabilities, costs, damages, expenses, claims, suits, allegations and demands, including, without limitation, all legal fees (incurred on a solicitor and own client basis) incurred by LAK CONSULTING GROUP or any LAK CONSULTING GROUP Representative in connection with any claim arising out of (i) any use or alleged use by you of this Site, (ii) any infringement, or claim or allegation of infringement, of the intellectual property rights or any other proprietary rights of a third party, (iii) any fraud, deliberate or wilful misconduct or negligence or breach of these terms and conditions committed by you or arising out of or in relation to any breach by you of the Terms of Use, or the representations, warranties and covenants you made by agreeing to these Terms of Use. LAK CONSULTING GROUP reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate reasonably with LAK CONSULTING GROUP defence of such claim.

Legal Jurisdiction

These Terms of Use and your use of the Site shall be governed by and construed in accordance with the laws of the Federal Republic of Germany and you, and LAK CONSULTING GROUP agree to submit to the exclusive jurisdiction of German courts.

Consent and Changes to Terms of Use

Your access to and use of the Site and all services provided by LAK CONSULTING GROUP are subject to this Terms of Use. By using the Sites and our services, you consent to this Terms of Use, Privacy Statement, Applicant Privacy Statement and Disclaimer described on the Site and represent that you are at least the age of majority in the jurisdiction of residence.

LAK CONSULTING GROUP reserves the right to amend this Terms of Use from time to time. Changes will take effect immediately upon their posting on this Site. It is your responsibility to review the Terms of Use for your continuous use, as your usage of the Sites and our services constitutes your agreement to these Terms of Use and any modifications to them.

Severability

In the event that any provision of these Terms of Use is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Use, such determination shall not affect the validity and enforceability of any other remaining provisions.

If these Terms of Use are available in other languages, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
