General terms and conditions of service

I. OBJECT

  1. These Terms and Conditions of Service (hereafter abbreviated to TCS) apply to all services that are provided by MEL, Lda., a company, established at Rua Virgílio da Silva Cristóvão 2, 2580-546 Alenquer, (hereafter designated solely as MEL) be it through its web platform www.mynewjob.today, or through any other mobile applications.
  2. For the purposes of the present TCS, the terms or expressions indicated below have the following meaning.
    1. platform – Online platform available via the website www.mynewjob.today, or through any other mobile applications. It allows its Users to obtain an online recruitment service, enabling :
      Candidates who validly sign up to the platform to have access to the best job offers, especially directed to their qualifications and professional aspirations.
    2. User — Any person, individual or legal, who uses the platform and seeks to benefit from the offer of its specialized recruitment services. Platform Users can be Candidates, Companies or Affiliates.
    3. Candidates — Any person of legal age who uses the platform in order to get the most suitable job offers to his/her professional expectations and motivations.
    4. Companies — Any legal person who uses the platform in order to obtain Candidates who have an adequate professional profile for the position they wish to fill in their company.
    5. Affiliates — Any natural person who is registered on the platform as a Candidate and recommends the platform to any User.
    6. Registration form — A form available on the platform for entering the data needed to create the job application.
    7. Account — Online recording of registered Users’ information on the platform.
    8. Validation Process – Internal process, which will evaluate and determine whether a Candidate is or is not accepted by MEL.
  3. The platform, available through www.mynewjob.today, makes a free service of online recruitment available to the Candidate, allowing Candidates who use the platform access to the best job offers, especially directed to their qualifications and professional aspirations.
  4. The platform is specifically aimed at recruiting talents by putting them in contact with the best existing job offers, offered by the leading companies in the market.
  5. The use of the platform is completely free to the Candidate.
  6. In the case of companies wishing to recruit through the platform, the contracting of the service may be done through an autonomous document, to be signed by MEL., and each Company, without any loss to what is provided in the TCS applicable to Companies.
  7. By using the platform, Users explicitly and without any reservation accept the General and Specific Terms of Service.
  8. A platform User who does not agree with the General and Specific Terms of Service must immediately suspend the use of the platform, not use MEL’s services and send an email to get@mynewjob.today, explicitly requesting the cancellation of his/her application.
  9. The present General and Specific Terms of Service revoke any prior agreement, communication, or understanding that may have taken place between the parties prior to the subscription of the services.

II. ELIGIBILITY AND ACCESS

  1. Only Candidates who are of legal age and who explicitly agree to the present TCS and the platform’s Privacy Policy may submit an application to the platform.
  2. If the Candidate does not accept the present TCS and Privacy Policy, they must immediately leave the platform.
  3. The effective use of the platform is considered an acceptance of the Terms and General Conditions of Service, the Specific Terms of Service, and the platform’s Privacy Policy.
  4. All Users should carefully read these General Terms of Service, our platform’s Privacy Policy, and the Specific Terms and Conditions of Service, being allowed to save or print them, if they so wish.
  5. Registration of Candidates is done by completing a registration form available on the platform.
  6. In this application form (the APPLY field), the Candidate will be asked to validly provide the following information: name, email address, mobile number, resume and cover letter). 
  7. The data provided will be a part of the Candidate’s database, and they may use them according to what is described in the Privacy Policy.
  8. By applying to a job through the platform, and by providing the data requested for registration, the Candidate states that the data provided is true and corresponds to the truth of his/her professional curriculum, corresponding academic qualifications and professional experience.
  9. If the Candidate provides wrong, incorrect or untrue data, MEL reserves the right to immediately remove the Candidate from the platform, without any prior notice, and also reserves the privilege of being able to require that they assume all liabilities that may arise from false statements made when signing up to the platform, and can trigger the legal means to canvass the civil and criminal liability that may exist.

III. REGISTRATION CANCELLATION

  1. The relationship established between MEL and the Candidates will be of indefinite duration.
  2. Notwithstanding the foregoing, a Candidate’s account may be freely cancelled by them at any time.
  3. To do so, the Candidate must email get@mynewjob.today, explicitly requesting the cancellation of his/her application.
  4. Upon completion of the cancellation process, an email will be sent confirming the cancellation of the Candidate’s application, the point at which the holder loses all rights conferred by the present General and Specific Terms and Conditions of Service.

IV. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

  1. Any User of the platform, be them a Candidate or a Company, expressly acknowledges that all available content on the site belongs to MEL or its partners and/or affiliates.
  2. The User acknowledges that “MyNewJob.Today” is a registered trademark and an exclusive property of MEL. Third parties are expressly prohibited to use, reproduce, steal, or give it any other kind of use that is unauthorized by its holder.
  3. The platform (text, images, brands, graphics, logos, buttons, software files, colour combinations, structure, selection, arrangement and presentation of content codes, source and object) is the exclusive property of MEL or others identified on the website. Its reproduction, distribution and/or public communication is completely prohibited, except for private and personal use.
  4. Users are expressly forbidden to access the platform through modified forms of software, including for the purpose of obtaining unauthorized access.
  5. The domain name www.mynewjob.today is the exclusive property of MEL, and its use by any other person, natural or legal, is prohibited.
  6. The improper and unauthorized use of the domain name referred to above constitutes a serious infringement of the rights of the person responsible for the platform and will motivate the initiation of legal proceedings against offenders.
  7. The contents, texts, photographs, drawings, images, logos, software, database and, in general, any existing intellectual creation on the website, as well as the website itself, as multimedia, are protected by copyright under the legislation in force, and its copying, unauthorized reproduction, or any kind of usurpation is completely prohibited.

V. PERSONAL DATA

  1. The data provided by Users (Candidates or Companies) through the platform will be included in an automated database. Its controller is MEL.
  2. All Users who apply to the platform expressly authorize that their personal details are treated by MEL, who in turn only uses them for the purposes identified in these General and Specific Terms and Conditions.
  3. Users who apply to the platform ensure that the transmitted personal data is true and accurate.
  4. The collection and retention of personal data by MEL are subject to the provisions of personal data protection legislation, including Law No. 67/98 of 26 October, which in turn may subcontract other entities to treat personal data.
  5. The processing of personal data by MEL is carried out with due compliance with the legality, loyalty and transparency obligations set forth in the General Regulation on Data Protection of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”).
  6. Without prejudice to the provisions of this clause, the data provided shall be processed in accordance with the provisions of the Platform Privacy Policy and the provisions of the General Regulation on Data Protection of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 of April 2016 (“GDPR”).

VI. RESPONSIBILITY

  1. MEL assumes no responsibility for any loss or sending of damaged, incomplete or incorrect data due to email problems and/or the malfunction of the platform.
  2. MEL reserves the right to cancel the application of any User whenever there is suspicion of incorrect or improper handling of personal data, or whenever a complaint that proves the violation of a third party’s legitimate rights is properly displayed.
  3. MEL cannot be held responsible for any technical failure or malfunction of any telephone lines or networks, online computer systems, servers or providers, IT equipment, software, failure of email service or content readers because of technical problems or traffic congestion on the Internet or on a website, or a combination of both, including injury or damage to a Candidate’s, any other person’s, or a company’s computer.
  4. MEL reserves the right to suspend, deny or terminate its service with any User whenever it unilaterally considers that the User uses or plans to use the platform in an illegal, abusive or non-authorized way that is not permitted under these General Terms and Conditions, or if the use or the User’s intention to create, or potential to create, has an adverse impact to other platform users.
  5. In no event shall MEL be liable for its Users’ or any other entity’s direct, indirect, incidental or consequential damages, whether arising out of contract, warranty, or tort (including negligence or strict liability) or any other liability.

VII. WAIVER

  1. To the extent permitted by the applicable laws, the services provided by the platform are provided “as is” and as they are available. MEL expressly rejects all warranties and conditions of any kind, expressed or implied, including but not limited to, the warranties or conditions of exploitation, fitness for a particular purpose, rights, private use, accuracy or non-infringement.
  2. Similarly, MEL does not guarantee or promise:
    1. Specific results from the use of the platform;
    2. That the services will meet your requirements;
    3. That the services will be available uninterruptedly, timely or error-free; or
    4. That the results that can be obtained by the use of the platform are accurate.
  3. MEL assumes no obligation of supervising the activities on the platform.

VIII. CHANGE OF GENERAL CONDITIONS

  1. MEL can modify these General Terms of Use at any time. To do so, it must (i) publish a revised version of this document on its platform and/or (ii) send information to its Users about the new Terms and Conditions. It is the Users’ responsibility to regularly consult and maintain their account’s email address, which MEL will use to contact them.
  2. The revised General Terms and Conditions are considered accepted by its Users if they continue to use the platform after the publication and/or communication of the new General Terms and Conditions of Use.

IX. OTHER PAGES

  1. The supply of links to any other page or location on the Internet is for the convenience of the Users and does not imply MEL's approval of this page, location or its contents. MEL does not control, review, and cannot be responsible for these outside websites or their content.
  2. These Terms and Conditions and our Privacy Policy do not apply to these outside websites.

XI. GENERAL DISPOSITIONS

  1. This agreement brings together all written and oral communications and defines the entire agreement between the parties relating to the MEL platform.
  2. Should any part of this agreement be considered unlawful, void, or ineffective in being understood, the remaining portions must remain in full force and effect. The unlawful, void or ineffective provision must be understood as nearly as possible to reflect the parties' intentions.
  3. All notifications under this agreement must be in writing and delivered by email.
  4. The General and Specific Terms of Service, as well as the relations established between MEL and its Users are governed by the Portuguese law in force.
  5. Any dispute arising between the MEL and the Users of the platform will be referred to the courts of the District of Lisbon, expressly waiving any other jurisdiction that may correspond to them.

The trademarks, logos and service brands displayed on the platform, as well as the entire contents of the website as multimedia, are the exclusive property of MEL, Lda., or of a third party. Specific terms and conditions of service – candidates

I. OBJECT

The present document establishes the Specific Terms and Conditions of Service (hereafter abbreviated to STCS), which regulate the hiring services offered to Candidates through www.myynewjob.today website — an exclusive property of MEL,Lda.. 

II. SERVICES PROVIDED

  1. MEL, through its platform specialized in recruiting, aims to make the recruitment process faster and more efficient, for Candidates and Companies.
  2. Thus, MEL will be responsible for providing the following services to Candidates who validly apply to the platform:
    1. Provide access to the platform interface;
    2. Ensure the integrity and smooth functioning of the platform;
    3. Ensure that the Candidate will be considered for the applied job offers or others more suitable that are available on the platform.

III. CANDIDATE REGISTRATION

  1. Each and every Candidate who wants to sign up for the platform must necessarily complete the online registration form, provide valid registration details, accept the General and Specific Terms and Conditions of Service and its Privacy Policy, and comply with all formalities and procedures communicated by the platform.
  2. If any User or Professional does not comply with the procedures described above, it will not be possible to continue to use the platform, nor benefit from MEL’s services.
  3. If MEL deems a profile inadequate to be part of the platform, it reserves the right not to accept a Candidate.

IV. HIRING

A. Application
  1. To hire the services offered by the MEL platform, the Candidate will have to previously apply on the www.mynewjob.today website.
  2. To do so, the Candidate must access the “Apply” link, available on said website, and should fill out the registration form with all requested data, and follow the instructions.
  3. For the correct and complete filling out of the platform’s registration form, the Candidate must provide the following information: name, email address, mobile phone, and resume.
  4. MEL does not guarantee or assume any responsibility for the accuracy of the data that is filled out by candidates. They are solely responsible for the veracity and accuracy of any information or data that is provided.
  5. Once the information is submitted through the platform, MEL will make a Candidate’s curriculum and answers validation process and assess if it meets the necessary conditions to continue the recruitment process.
  6. If the MEL team perceives that the Candidate does not meet the requirements to be a successful Candidate, he/she will receive an email to report the refusal of his/her application on the platform for that job.
  7. If MEL internally validates the application of the Candidate, he/she will receive information about the recruitment process.
B. Use
  1. Whenever there is a positive validation of the application, the Candidate will have access to concrete information about the job identified by the platform and may decide whether to continue the process or not. 
  2. After that phase, the Candidate will be invited to meet MEL's clients and perform under the recruitment process designed for that Job. 
  3. If the Candidate is successful, they will receive a job offer, that can be managed directly by MEL's client. 
  4. In case he/she refuses the proposal, the Candidate will not receive any further information about it, and the process will terminate at that time.
  5. In the case referred to above, a Candidate and Company may also exchange messages, deepen mutual understanding, and determine whether or not to share their contacts and formalize possible hiring.
  6. MEL’s intervention ends with the hiring of the Candidate by the Company, or after both parties desist from contracting. 

V. DISCLAIMER

  1. The Candidate acknowledges and agrees that MEL does not guarantee or assume any responsibility for the concrete and effective existence of a match, and does not guarantee a hire.
  2. MEL merely aims to turn recruitment into a more efficient process, and for this purpose provides opportunities for Candidates and Companies to find what best fits each other. It does not guarantee or assume any responsibility in hiring workers or employees. It does not guarantee the hiring of its Users, Candidates or Companies.

VI. COST

  1. Applying to the platform is completely free for Candidates. 

VII. DURATION

  1. The relationship established between MEL and the Candidates has an indefinite duration.
  2. Notwithstanding the foregoing, a Candidate’s application may be cancelled by them at any time.
  3. To do so, the Candidate must email get@mynewjob.today explicitly requesting the cancellation of his/her application.

VIII. CODE OF CONDUCT

  1. All Candidates are required to comply with the following code of conduct:
    1. All Candidates declare, under their sole responsibility, that they will act in compliance with applicable standards, in a responsible, respectful, and diligent way, and in good faith.
    2. All Candidates are committed under their sole responsibility to submit complete, accurate and truthful information about their identity, literary skills, and professional experience.
  2. The following Candidate's conduct is expressly prohibited:
    1. Creating false identities, acting on behalf of third parties without legitimacy, impersonating another entity and/or stealing the identity of others.
    2. Providing false data. All offered and supplied data must be completely accurate and true.
    3. Prevaricating, falsifying documents and/or signatures, infringing laws, regulations or any applicable regulations.
    4. Applying and using the platform on behalf of an entity or person without being duly authorized to that effect.
    5. Manipulating and/or altering any platform tools.
    6. Not respecting the rules and predetermined processes to access and use the platform, and using methods that may cause damage to the platform and/or third-party systems.
    7. Using the platform and/or receiving information from Companies or Candidates for purposes other than those provided in these STCS.
    8. Sending unsolicited advertising.
    9. Transmitting any information or marketing any material, product or service of illegal, injurious, defamatory, harmful, vulgar, obscene or considered objectionable nature through the platform.

X. INTELLECTUAL PROPERTY AND COPYRIGHT

  1. Candidates who apply for the platform expressly acknowledge and accept that MEL is the exclusive owner of all intellectual property rights relating to the platform’s software, including images, videos, graphics, and all elements of the platform, and do not acquire any right over them by registering on the platform or arising from its use.
  2. Users registered on the platform recognize and accept that MEL is the exclusive owner of all rights and titles relating to the MEL trademarks, not acquiring any rights on them by registering on the platform or arising from its use.

XI. CONDITION CHANGES

  1. MEL reserves the right to modify at any time, without prior notice, the presentation, the layout and/or the content of the platform, as well as the wording of the General Terms and Conditions of Service, the Specific Conditions of Contracting of Services, and its Privacy Policy.
  2. In this event, MEL will provide all documents on its platform, containing their updated versions. They will be visible and available for online consultation.
  3. Users should carefully read these documents when accessing the platform and should consult them frequently.
  4. Reading and prior acceptance of the Specific Conditions of Contracting, General Terms and Conditions of Service, and Privacy Policy are essential for registering and subscribing to any services available on the platform.

XII. INTEGRITY

  1. The present STCS replace any other agreements or contracts, written or oral, that both parties might have made before and/or during the due course of the project.
  2. Any changes to the present STCS will have to be made by mutual written agreement between FFMM and its Users.

XIII. TRANSFER OF RIGHTS AND SUBCONTRACTING OBLIGATIONS

  1. Users cannot assign and/or transfer the rights and obligations of the present STCS.
  2. MEL reserves the right of being able to assign and/or freely transfer, at any time and without authorization of its Users and/or professionals, the rights and obligations contained in the present STCS.
  3. MEL also reserves the right of being able to subcontract other individual or legal persons in order to fulfil their obligations under the present STCS.

XIV. COMMUNICATIONS

  1. All communications between MEL and Candidates regarding the present STCS and/or applying to the platform must be made in writing and in accordance with the notification procedures set out in these STCS.
  2. For all other cases not expressly covered in the STCS, all written communications should be sent via by email to the following email address: get@mynewjob.today. 

XV. FINAL DISPOSITIONS

  1. Partial Invalidity. If any clause of the present STCS is to be found invalid or revocable in its entirety or in part, or impossible to comply by law or by a third-party conduct, the rest will remain in force.
  2. Failure to Exercise Rights. The failure to exercise, or late or partial exercise, of any right that assists MEL under the present STCS, no matter the resignation of that right and does not prevent its subsequent exercise.

XVI. LAW AND JURISDICTION

  1. FFMM, as well as the Candidates, will make their best efforts to find an amicable resolution regarding any doubt or dispute arising in connection with the implementation of the present STCS.
  2. If it is not possible to reach an amicable settlement of the conflict in accordance with the preceding paragraph, the questions concerning the interpretation, validity, execution or termination of the Agreement shall be decided by the District Court of Lisbon, with expressed waiver of any other.
