Mail này nhằm cung cấp chính sách của chúng tôi về Bảo vệ dữ liệu cá nhân theo đúng quy định pháp luật hiện hành (hiện tại là Nghị định số 13/2023/NĐ-CP về bảo vệ dữ liệu cá nhân do Chính phủ ban hành ngày 17 tháng 4 năm 2023, có hiệu lực từ ngày 01 tháng 7 năm 2023 và tất cả văn bản thay thế, điều chỉnh, bổ sung có hiệu lực theo thời gian).
This mail is to provide our policy for Personal Data Protection in compliance with applicable laws (currently is Decree No. 13/2023/ND-CP on personal data protection issued by the Government on 17 April 2023, valid from 01 July 2023 and any replacement, amendments and supplements legislation coming into effect from time to time).

Để xử lý bước tiếp theo của quy trình tuyển dụng, vui lòng trả lời email này bằng email có nội dung ghi rõ "Tôi đồng ý để Savills xử lý Dữ liệu cá nhân của tôi theo chính sách đã cung cấp". Sự đồng ý đó là bắt buộc theo luật hiện hành. Nếu bạn không cung cấp email thể hiện sự đồng ý như trên, Savills có thể không xử lý được mẫu đơn đăng ký của bạn. Sự đồng ý của bạn là tự nguyện và được thực hiện sau khi bạn hiểu rõ chính sách Bảo vệ Dữ liệu Cá nhân của chúng tôi như sau.
To process next step of the recruitment procedure, please reply to this mail by an email state that “I consent for the processing of my Personal Data by Savills as the provided policy”. Such consent is required by applicable laws. If you do not provide sufficient consent, Savills may not be able to process your application form. Your consent is voluntary and made after clearly understanding our policy of Personal Data Protection as below.

1. Mục đích: / Purpose: 

Dữ liệu cá nhân được cung cấp trong biểu mẫu đơn xin việc tại Savills sẽ được sử dụng cho mục đích tuyển dụng và các mục đích liên quan đến việc làm khác. Dữ liệu có thể được cung cấp cho các công ty con và các tổ chức hoặc cơ quan khác được Savills ủy quyền để xử lý thông tin cho các mục đích liên quan đến việc tuyển dụng và việc làm tại Savills, ví dụ như đánh giá trình độ, kiểm tra y tế, tham chiếu của nhà tuyển dụng và kiểm tra tính chính trực, v.v. khi cần thiết.

The personal data provided in the application forms for openings in Savills will be used for recruitment and other employment-related purposes. It may be provided to its subsidiaries and other organisations or agencies authorised by Savills to process the information for purposes relating to recruitment by and employment with Savills e.g. qualifications assessment, medical examination, employer reference and integrity checking, etc. where necessary.

2. Các loại dữ liệu cá nhân cần thu thập: / Categories of personal data to collect:

Việc bạn cung cấp dữ liệu cá nhân được yêu cầu trong biểu mẫu đăng ký là bắt buộc, ngoại trừ các mục được đánh dấu là tùy chọn. Các loại dữ liệu cá nhân cần thu thập bởi Savills bao gồm: i . Dữ liệu cá nhân chung: Họ, tên đệm, tên, tên khác (nếu có); Ngày sinh; ngày mất hoặc mất tích; Giới tính; Nơi sinh, nơi đăng ký khai sinh, hộ khẩu thường trú, tạm trú, nơi cư trú hiện tại, quê quán, địa chỉ liên lạc; Quốc tịch; Hình ảnh cá nhân; Số điện thoại, số chứng minh thư nhân dân, số định danh cá nhân, số hộ chiếu, số giấy phép lái xe, biển số xe, mã số thuế cá nhân, số bảo hiểm xã hội, số thẻ bảo hiểm y tế; Tình trạng hôn nhân; Thông tin về mối quan hệ gia đình (cha mẹ, con cái); Thông tin về tài khoản kỹ thuật số của cá nhân; Dữ liệu cá nhân phản ánh các hoạt động và lịch sử hoạt động trên không gian mạng; Thông tin liên quan đến một cá nhân hoặc được sử dụng để xác định một cá nhân khác với thông tin được chỉ định là Dữ liệu cá nhân nhạy cảm; và ii. Dữ liệu cá nhân nhạy cảm: Quan điểm chính trị, quan điểm tôn giáo; Tình trạng sức khỏe và đời tư được ghi trong hồ sơ y tế, không bao gồm thông tin về nhóm máu; Thông tin liên quan đến nguồn gốc chủng tộc và nguồn gốc dân tộc; Thông tin về đặc điểm di truyền hoặc đặc điểm mắc phải của cá nhân; Thông tin về đặc điểm thể chất và đặc điểm sinh học của cá nhân; Thông tin về đời sống tình dục và khuynh hướng tình dục của cá nhân; Dữ liệu về tội phạm và hoạt động phạm tội do cơ quan thực thi pháp luật thu thập và lưu trữ; Thông tin về Khách hàng của tổ chức tín dụng, chi nhánh ngân hàng nước ngoài, tổ chức cung ứng dịch vụ thanh toán và các tổ chức được cấp phép khác, bao gồm: Thông tin nhận dạng khách hàng theo quy định của pháp luật, tài khoản, tiền gửi, tài sản gửi, giao dịch, tổ chức, cá nhân là người bảo lãnh tại tổ chức tín dụng, chi nhánh ngân hàng, tổ chức cung ứng dịch vụ thanh toán; Dữ liệu về vị trí của cá nhân được xác định thông qua dịch vụ định vị; Dữ liệu cá nhân khác theo quy định của pháp luật là dữ liệu đặc biệt và bắt buộc phải bảo mật.

Đơn xin việc của bạn sẽ không được xem xét nếu bạn không cung cấp tất cả thông tin bắt buộc hoặc không nêu rõ trong các tuyên bố của bạn rằng bạn có trình độ, đào tạo, kinh nghiệm hoặc các yêu cầu tối thiểu khác được chỉ định cho công việc. Bạn được yêu cầu thông báo cho Savills nếu có bất kỳ thay đổi nào sau đó đối với thông tin được cung cấp sau khi nộp đơn xin việc.

Your provision of the personal data requested in the application forms is obligatory, except for the items marked as optional. Categories of personal data to collect by Savills includes: i. General Personal Data: Last name, middle name, first name, other names (if any); Date of birth; date of death or going missing; Gender; Place of birth, registered place of birth, permanent residence, temporary residence, current residence, hometown, contact address; Nationality; Personal images; Phone number, ID card number, personal identification number, passport number, driver’s license number, plate number, personal tax code, social insurance number, medical insurance card number; Marital status; Information about family relationship (parents, children); Information about individuals’ digital accounts; Personal Data reflecting activities and operation history in cyberspace; Information associated with an individual or used to identify an individual other than that specified as sensitive Personal Data; and ii. Sensitive Personal Data: Political views, religious views; Health status and private life recorded in medical records, excluding information about blood type; Information involved to racial origin and ethnic origin; Information about genetic or acquired characteristics of individuals; Information about the individual’s physical characteristics and biological characteristics; Information about the individual’s sex life and sexual orientation; Data on crimes and criminal activities collected and stored by law enforcement agencies; Information on Customers of credit institutions, foreign bank branches, payment service providers and other licensed institutions, including: Customer identification as prescribed by law, accounts, deposits, deposited assets, transactions, organizations and individuals that are guarantors at credit institutions, bank branches, and payment service providers; Data on the individual’s location determined through positioning services; Other Personal Data stipulated by law to be special and required necessary confidentiality.

Your application will not be considered if you fail to provide all of the required information, or it is not clear from your statements that you have the minimum qualifications, training, experience or other requirements specified for the job. You are requested to notify Savills if there are any subsequent changes to the information provided after submission of the application form.

3. Phương pháp xử lý Dữ liệu cá nhân: / Method of processing Personal Data:

Dữ liệu cá nhân sẽ được xử lý bằng các phương pháp: thủ công, cơ học, điện tử tùy thuộc vào tình hình và bản chất của Dữ liệu cá nhân.

Personal Data shall be processed using methods of: manual, mechanical, electronic processing depends on the situation and the nature of the Personal Data.

4. Thời gian bắt đầu và kết thúc: / Starting and ending time: 

Bắt đầu từ thời điểm nhận được sự đồng ý cho đến khi mục đích được thực hiện.

Starting at the time of receiving the consent until the purpose be fulfilled.

5. Những hậu quả không mong muốn có thể xảy ra: / Unwanted consequences that may occur:

Có khả năng xảy ra hậu quả và thiệt hại không mong muốn ngoài những tác động tích cực từ việc Savills xử lý Dữ liệu cá nhân như đã nêu trong Khoản 1 của Điều này, việc xử lý Dữ liệu cá nhân, đặc biệt là việc lưu trữ, có thể tạo ra rủi ro cho Savills và Chủ thể dữ liệu. Hậu quả không mong muốn là các cuộc tấn công hoặc lỗi hệ thống dẫn đến rò rỉ Dữ liệu cá nhân và các thiệt hại phổ biến có thể xảy ra đối với Chủ thể dữ liệu và Savills như sau:

There is possibility of unwanted consequences and damages in addition to positive impacts from Savills’ processing of Personal Data as stated in Clause 1 of this Article, the processing of Personal Data, especially the storage, may create risks to Savills and Data Subjects. Unwanted consequences are attacks or system errors leading to Personal Data leakage and common damages that can occur to Data Subjects and Savills as follows:

i. Quảng cáo không mong muốn hoặc gây phiền hà;

Unwanted or troublesome marketing and advertising;

ii. Gian lận;

Fraud risk;

iii. Các tội phạm và hành vi vi phạm pháp luật khác.

Other crimes and violations of law.



6. Quyền và nghĩa vụ của Chủ thể dữ liệu: / Data Subject’s rights and obligations:

Chủ thể dữ liệu có quyền được thông báo; đồng ý; rút lại sự đồng ý; xóa Dữ liệu cá nhân; hạn chế xử lý dữ liệu; thu thập Dữ liệu cá nhân; phản đối việc xử lý; khiếu nại, tố cáo và khởi kiện; yêu cầu bồi thường thiệt hại; tự vệ.

Data Subject has the right to be informed; consent; withdraw consent; delete Personal Data; restrict data processing; obtain Personal Data; object to processing; complain, denounce and sue; request compensation for damages; self-defend.

Chủ thể dữ liệu có nghĩa vụ bảo vệ dữ liệu cá nhân của mình; yêu cầu các tổ chức, cá nhân có liên quan bảo vệ dữ liệu cá nhân của mình; tôn trọng và bảo vệ dữ liệu cá nhân của người khác; cung cấp đầy đủ, chính xác dữ liệu cá nhân của mình khi đồng ý cho xử lý; tham gia phổ biến kỹ năng bảo vệ dữ liệu cá nhân; tuân thủ quy định của pháp luật về bảo vệ dữ liệu cá nhân và ngăn chặn hành vi vi phạm quy định về bảo vệ dữ liệu cá nhân.

Data Subject has obligations to protect his/her own personal data; request relevant organizations and individuals to protect his/her personal data; respect and protect others’ personal data; fully and accurately provide his/her personal data when he/she consents to the processing; participate in dissemination of personal data protection skills; comply with regulations of law on protection of personal data and prevent violations against regulations on protection of personal data.

7. Xử lý yêu cầu của chủ thể dữ liệu: / Data subjects’ request handling: 

Savills công nhận mọi quyền của Chủ thể dữ liệu theo Nghị định 13/2023/ND-CP (sau đây gọi là “Quyền của Chủ thể dữ liệu”). Để thực hiện Quyền của Chủ thể dữ liệu, một cá nhân phải hoàn thành biểu mẫu do Nghị định 13/2023/ND-CP quy định và gửi biểu mẫu đã hoàn thành cho Savills theo bất kỳ cách nào sau đây:

Savills recognizes all Data Subject’s rights in accordance with the Decree 13/2023/ND-CP (hereinafter refer to as “Data Subject’s Right”). To perform Data Subject’s Right, an individual should complete the form specified by the Decree 13/2023/ND-CP and submit the completed form to Savills in any one of the following ways:

- Qua đường bưu điện hoặc trực tiếp: Savills Việt Nam – Tầng 18, Tòa nhà Doji , 81-85 Hàm Nghi, P. Nguyễn Thái Bình, TP.HCM – Phòng Nhân sự.

By post or in person: Savills Vietnam – 18th floor, Doji Tower, 81-85 Ham Nghi Str., Nguyen Thai Binh ward, HCMC – HR Department.

Khi xử lý yêu cầu về Quyền của Chủ thể dữ liệu, Savills sẽ kiểm tra danh tính của người yêu cầu để đảm bảo rằng người đó là người có thẩm quyền hợp pháp để thực hiện Quyền của Chủ thể dữ liệu.

Savills duy trì Sổ đăng ký Yêu cầu về Quyền của Chủ thể Dữ liệu ghi lại các yêu cầu về Quyền của Chủ thể Dữ liệu đã nhận được.

When handling a Data Subject’s Right request, Savills will check the identity of the requester to ensure that he/she is the person legally entitled to perform Data Subject’s Right.

Savills maintains a Register on Requests for Data Subject’s Right recording the Data Subject’s Right requests received.

8. Các tổ chức và cá nhân xử lý Dữ liệu cá nhân: / Organizations and individuals processing Personal Data:

a. Trong trường hợp nhận được sự đồng ý của Chủ thể dữ liệu và/hoặc theo quy định của pháp luật, Savills có thể xem xét gửi Dữ liệu cá nhân tới các tổ chức, cá nhân sau:

In case of receiving consent of the Data Subject and/or in accordance with the law, Savills may consider sending Personal Data to the following organizations and individuals:

- Các tổ chức, cá nhân trên lãnh thổ Việt Nam: Cơ quan quản lý cơ sở dữ liệu do Chính phủ xây dựng; Chủ thể có quyền quyết định về việc xử lý Dữ liệu cá nhân của người bị tuyên bố mất tích hoặc Dữ liệu cá nhân và/hoặc Dữ liệu cá nhân của trẻ em theo quy định tại Điều 19 và Điều 20 Nghị định 13/2023/NĐ-CP; Tổ chức, cá nhân trong nước cung cấp dịch vụ Xử lý Dữ liệu cá nhân; Cơ quan có thẩm quyền theo quy định của pháp luật; Tổ chức, cá nhân trong nước khác trên cơ sở tuân thủ pháp luật và được sự đồng ý của Chủ thể dữ liệu.

Organizations and individuals in the territory of Vietnam; Database management agency built by the Government; The subject has the right to decide on the processing of Personal Data of a person declared missing or Personal Data and/or Personal Data of children according to regulations of Article 19 and Article 20 of Decree 13/2023/ND-CP; Domestic organizations and individuals providing Personal Data Processing services; Competent authority as stipulated by law; Other domestic organizations and individuals based on the compliance with the law and the consent of the Data Subject.

- Tổ chức, cá nhân ngoài lãnh thổ Việt Nam: Các tổ chức, công ty, bộ phận quản lý của Savills ở nước ngoài để xử lý theo mục đích do Chủ thể dữ liệu thỏa thuận; Các tổ chức, cá nhân nước ngoài cung cấp dịch vụ Xử lý dữ liệu cá nhân; Cơ quan có thẩm quyền theo quy định của pháp luật; Các tổ chức, cá nhân khác tuân thủ pháp luật và được sự đồng ý của Chủ thể dữ liệu.

Organizations and individuals outside the territory of Vietnam: Organizations, companies, and management departments of Savills abroad for processing in accordance with the purpose agreed by the Data Subject; Foreign organizations and individuals providing Personal Data Processing services; Competent authority as stipulated by law; Other organizations and individuals in compliance with the law and with the consent of the Data Subject.

b. Các trường hợp gửi Dữ liệu cá nhân ra ngoài lãnh thổ Việt Nam: Trường hợp gửi Dữ liệu cá nhân cho các tổ chức, cá nhân theo quy định pháp luật để xử lý theo mục đích mà Chủ thể dữ liệu đã thỏa thuận; Trường hợp Savills xử lý Dữ liệu cá nhân bằng hệ thống tự động đặt ngoài lãnh thổ Việt Nam, các hệ thống này phải đáp ứng các yêu cầu kỹ thuật, theo đúng mục đích quy định tại Chính sách này và theo quy định của pháp luật.

Cases of sending Personal Data outside the territory of Vietnam: In case of sending Personal Data to organizations or individuals as stipulated in applicable laws for processing according to the purpose agreed by the Data Subject; In case Savills processes Personal Data using an automatic system located outside the territory of Vietnam to meet technical requirements, in accordance with the purposes stipulated in this Policy and in accordance with regulations of the law.

c. Chúng tôi có trách nhiệm thực hiện các bước để bảo vệ Dữ liệu cá nhân của bạn theo Tuyên bố Chính sách bảo mật này.

We take steps to safeguard your Personal Data in accordance with this Privacy Policy Statement.

d. Savills chỉ chuyển giao, xử lý ra nước ngoài sau khi lập hồ sơ đánh giá tác động của việc chuyển giao dữ liệu cá nhân ra nước ngoài và thực hiện các thủ tục quy định tại Nghị định 13/NĐ-CP.

Savills only transfers, and processes abroad after making a dossier on assessment of impact of outbound transfer of personal data and carries out the procedures specified in Decree 13/ND-CP.



9. Báo cáo sự cố và xử lý vi phạm: / Incident Reporting and Breach Handling

Savills sẽ thực hiện báo cáo trong trường hợp mất mát hoặc rò rỉ dữ liệu cá nhân, hoặc có lý do để tin rằng dữ liệu cá nhân do Savills nắm giữ đã bị xâm phạm, theo quy định của luật hiện hành.

Savills shall do the report in case there is loss or leakage of personal data, or there is a reason to believe that the personal data held by Savills has been compromised, in compliance with applicable laws.
