JOB SUMMARY / PRIMARY ACCOUNTABILITIES:

1. The Legal Officer is generally tasked to ensure that endorsed foreclosed and dacion accounts are prepared timely for pleadings and motions preparation, assessment, filing and related documentation.

2. The Legal Officer handles legal processes involving writ of possession(WOP) and related property proceedings for bank acquired assets.

3. The Legal Officer is responsible for providing administrative assistance to the team, reviewing contracts and other legal documents.

4. The Legal Officer appears as bank authorized representative/complaining witness for and on behalf of the Bank in the prosecution of criminal cases in the Office of the Prosecutor and before the courts of justice having jurisdiction over the claims under the direct control and supervision of Public Prosecutor.

5. The Legal Officer manages the delinquent/defaulted account's portfolio to minimize losses and maximize recovery.

6. The Legal Officer initiates demand and reminder letters to all defaulting customers and reviews all Sales Contract Receivables (SCR) files for proper documentation and monitoring.

7. The Legal Officer assists in the expeditious turnover and sale of foreclosed properties by resolving legal impediments.

8. The Legal Officer advises the Asset Management Team on legal risks, compliance requirements and best practices in property disposition.

9. The Legal Officer is generally tasked to ensure that all policies, guidelines, procedures and internal controls set by the management and other regulator bodies are complied with and undertaken by the department.

SPECIFIC DUTIES AND RESPONSILIBITIES:

A. Management

1. Set the strategy and goals for the recovery team (AMD) which should be aligned with the organizational goals.

2. Conducts Performance Evaluation.

3. Participates in strategic and operational planning activities of the company.

4. Performs other related tasks that may be assigned by immediate superiors.

B. Recovery Accounts Management

1. Ensures timely preparation, assessment and filing of pleadings and related documentation.

2. Enhance trial proceedings by organizing evidence, preparing exhibits and scheduling witnesses.

3. Prepare files for accounts in need of additional legal action.

4. Monitors schedule for hearing.

5. Ensures quality court pleadings and that there will be no court dismissal.

6. Ensures targets and goals of the Asset Management Team are achieved.

Qualification Guidelines:

Education: Must hold a Bachelor of Laws/Juris Doctor and member of the Integrated Bar of the Philippines or Paralegal diploma

Experience: Preferably 3-5 years of extensive experience in court litigation from reputable banking/financial services industry and law firm.

Others: Must be able to analyze and solve complex problems. Strong experience in various legal advisory and deep knowledge of corporate and commercial laws. With strong analytical, leadership, interpersonal and negotiation skills
