2. Purpose of Use
Your personal data will be used only for the following purposes:
- To review and assess your application for the contractor role you applied for.
- To communicate with you during the recruitment process.
- To consider you for alternative or future contractor opportunities within VargasAndrews or with our clients (based on your consent or our legitimate interest).
- To respond to unsolicited applications.
- To send you updates about relevant opportunities (only with your consent).
- To process your application through third-party artificial intelligence (AI) tools for screening, scoring, or matching purposes.
3. Data Sharing
We may share your personal data, including interview recordings, with:
- Internal recruitment and contractor engagement teams directly involved in the process.
- Clients for whom the contractor role is being sourced, which may include sharing your CV, interview transcript, and/or recorded interview.
- External recruitment partners engaged to assist in the contractor sourcing process.
- Third-party AI service providers who process candidate information on our behalf for application analysis and shortlisting, under strict confidentiality and security agreements.
We will not sell your personal data to third parties. Any sharing will be limited to what is necessary for contractor engagement purposes.
4. Cross-Border Data Transfers
If your data is transferred to or stored in a country outside your own (including the U.S. and the Philippines), we will ensure that appropriate safeguards are in place to protect your information in compliance with applicable laws (e.g., Standard Contractual Clauses under GDPR, contractual obligations, or equivalent protections).
5. Data Retention
- We retain your data for 36 months from your last application.
- If a suitable contractor opportunity arises after that period, we may contact you to seek consent for further retention.

- Access – Request a copy of the personal data we hold about you, excluding internal evaluation notes, proprietary assessment materials, and full copies of recorded interviews. For recorded interviews, we may provide a written summary of your responses instead of the full recording.

- Erasure – Request deletion of your data, subject to legal retention requirements.
- Restriction – Limit how we process your data.
- Portability – Receive your data in a portable format.
- Objection – Object to certain processing, such as marketing or future opportunity consideration.
- Withdraw Consent – Where processing is based on consent, you can withdraw it at any time.

8. Data Security
We take reasonable technical and organizational measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. Access to personal data is limited to authorized personnel only, and interview recordings are stored securely.
9. Governing Law
This Privacy Policy is governed by the laws of the State of Delaware, USA. However, local data privacy laws in your country of residence (e.g., GDPR in the EU, the Australian Privacy Act, or the Philippine Data Privacy Act) may also apply and will prevail in case of conflict.

10. Consent Clause for Position Descriptions
By submitting your application for this contractor opportunity, you acknowledge that you have read and understood the VargasAndrews Recruitment Privacy Notice and consent to the collection, use, processing, and cross-border transfer of your personal and sensitive personal information — including CV, application documents, assessments, recorded interviews, and related recruitment materials — for the purposes of evaluation, communication, and potential engagement as an independent contractor with VargasAndrews or its clients. You also consent to the sharing of this information with internal recruitment teams, clients, external recruitment partners, and third-party AI service providers, in accordance with the Philippine Data Privacy Act of 2012. You understand your rights to access, correct, or request deletion of your data, and that certain materials, such as full interview recordings, are excluded from access requests.
