Terms and Conditions Vivaris Jobs
1. Definitions
- "Agency" refers to Vivaris Jobs.
- "Client" refers to the employer or company engaging the Agency’s services.
- "Candidate" refers to the job seeker presented to the Client by the Agency.
- "Agreement" refers to the terms and conditions outlined in this document.
2. Agency Services
- The Agency agrees to provide recruitment, placement, and employment services as per the Client's requirements.
- The Agency will screen candidates to the best of its ability to ensure suitability for the role.
3. Fees and Payment Terms
- The Client agrees to pay the Agency a service fee as outlined in the signed contract or agreement.
- Payment must be made within 7 days of receiving the invoice.
- Late payments may incur interest at a rate of 5% per month.
4. Candidate Representation
- The Agency represents candidates to the best of its knowledge and ensures accuracy in qualifications and work history.
- The Agency is not liable for any misrepresentation by the Candidate.
- The Client is responsible for verifying all references, certifications, and employment history before hiring the Candidate.
5. Replacement Guarantee
- If the Candidate resigns or is terminated within 1 month of employment, the Agency will provide a replacement Candidate at no additional cost.
- This guarantee does not apply if:
- The termination is due to redundancy or changes in the Client’s business.
- The Client breaches any of these terms.
6. Confidentiality
- Both the Agency and the Client agree to keep all information shared during the recruitment process confidential.
- The Client agrees not to share Candidate details with third parties without prior consent from the Agency.
7. Accommodation and Benefits
- If the Client provides accommodation or benefits as part of the employment package, the Client is solely responsible for ensuring these are provided as agreed.
- The Agency is not responsible for any disputes arising from accommodation or benefits issues.
8. Liability
- The Agency is not liable for any loss, damage, or injury caused by a Candidate during or after their employment.
- The Agency is not responsible for any loss arising from the Client’s use of the Agency’s services, including failed placements or Candidate resignations.
9. Termination of Agreement
- Either party may terminate this Agreement with 30 days written notice.
- The Client is liable for any outstanding fees up to the date of termination.
10. Governing Law
- This Agreement is governed by the laws of Rijeka-Croatia.
- Any disputes arising will be resolved in accordance with the laws of this jurisdiction.
11. Amendments
- The Agency reserves the right to amend these Terms and Conditions at any time, with prior notice to the Client.
12. Acceptance
By engaging the Agency’s services, the Client agrees to these Terms and Conditions.
