I. LEGAL DISCLAIMER: CRITICAL UPDATES FOR APPLICANTS

1. Application Nature Clarification:

"Wokolako accepts applications for roles involving human professionals trained in AI tools, autonomous AI development, and related services. Submission of an application does not guarantee an interview, offer, or employment. Outcomes depend on qualifications, availability, and company needs, with possible use of AI-assisted screening tools for efficiency."

2. No Replacement Guarantee:

"Applying to Wokolako does not guarantee job placement, career advancement, or specific outcomes from upskilling programs offered post-hire."

3. Tool Agnosticism:

"We use third-party AI tools (e.g., applicant tracking systems) and proprietary solutions from Gwilaco Labs during the application review. We disclaim liability for third-party tool failures; proprietary tools carry limited warranties (see Section D)."

4. Ethical AI Boundary:

"Applicants must provide accurate information; any unethical submissions (e.g., falsified credentials or AI-generated content misrepresented as original) will result in disqualification. Wokolako uses AI ethically in screening but ensures human oversight to avoid bias. Applicants indemnify Wokolako against any claims arising from their submissions."

II. TERMS OF SERVICE: MODIFIED CLAUSES FOR APPLICANTS

A. Parties & Application Process

Parties: Wokolako ("Company") and you ("Applicant").

Process:

1. Submission: Applications may include resumes, portfolios, or work samples via our website, email, or third-party platforms.

2. Review: We evaluate based on merit, skills, and fit; no discrimination on protected characteristics (e.g., race, gender, age)

Background Checks: Wokolako may conduct background checks where deemed appropriate, primarily for verifying experiences, education, and general claimed personality/way of being through references or witnesses. Applicants consent to such checks as part of the process

International Applicants: Wokolako has sole discretion over hiring locations at any time. Certain roles or projects may be restricted to specific regions based on client needs, company convenience, or operational requirements.

3. Upskilling Opportunities: Selected applicants may enter training programs as part of onboarding

4. Custom Opportunities: Applications may lead to dedicated placements or talent pool inclusion.

Salary Transparency: Job postings will indicate the minimum compensation offered for roles, aligned with the minimum wage of the country where the applicant will work (though Wokolako commits to paying above this minimum for clarity and fairness).

B. Applicant Obligation

Scope

Applicants agree to provide truthful information and consent to data processing for hiring purposes. You may not poach Wokolako talent or clients identified during the process for 24 months post-application without written consent.

Performance Metrics:

Not applicable at application stage; post-hire metrics defined in employment agreements.

C. Upskilling Programs

Outcome Limits:

If invited to training as part of the application (e.g., pre-hire assessments), completion does not guarantee employment. Certification requires validation as outlined in company policies.**

D. Intellectual Property

Ownership Boundaries:

1. Applicant Submissions: IP in resumes or samples remains yours, but by submitting, you grant Wokolako a non-exclusive license to review and store for hiring.

2. Gwilaco Labs: Tools used in assessments belong to Wokolako.

3. Wokolako Property: Any ideas or innovations shared during interviews (e.g., AI concepts) may be considered company property if developed further, unless covered by a separate agreement.

Training Materials:

If accessed during application (e.g., sample curricula), Wokolako retains IP; non-transferable use only.

E. Compliance & Ethics

Data Handling:

1. Applicants: Your data (e.g., PII in resumes) is handled per our Privacy Policy; we adhere to GDPR, CCPA/CPRA, and other laws.

2. Wokolako: Does not store applicant data beyond necessary (e.g., deleted if rejected after 6 months) unless for talent pool with consent. Requires DPA for sensitive data.

3. Autonomous Tools: AI screening processes data in secure environments; no retention without consent.

Changes to Terms: These Terms and Conditions are subject to change. Any significant changes will be communicated to relevant parties (e.g., via email or website updates) in accordance with applicable law.

III. POLICIES: ENHANCED PROVISIONS FOR APPLICANTS

1. Acceptable Use Policy (AUP)

For Applicants: Submissions must be original; encourage innovation in responses, but do not share confidential info from prior employers. Generic best practices are acceptable.

2. Privacy Policy

Data Retention:

Applicant data: Retained for 6 months post-submission if rejected, or longer for talent pool with opt-in consent. Purged after 12 months of inactivity, per CCPA/GDPR updates (e.g., right to deletion).

3. Withdrawal/Rejection Policy

Applicants may withdraw at any time. No refunds for any application fees (if applicable). Rejections are final; feedback will be provided at least through notices (e.g., email). Specific reasoning is at Wokolako's discretion and may depend on the rejection stage. No appeals process unless discrimination is alleged.

4. Growth & Ethics Policy

Applicant Commitment: Align with Wokolako's ethical AI use. Discrimination or unethical behavior during application triggers disqualification.
