Komforce Pty Ltd – Applicant Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of Komforce Pty Ltd’s (“Komforce”, “we”, “us”, or “our”) recruitment services when you submit a job application via our career pages (www.komforce.com/careers, https://www.careers-page.com/komforce) or other job boards where Komforce advertises.

By submitting your application, you agree to be bound by these Terms.

1. Eligibility and Accuracy of Information

• You warrant that you are at least 18 years old or legally able to enter into agreements in your country.

• You agree to provide true, accurate, current, and complete information in your application and supporting documents.

• Komforce reserves the right to verify your information and to reject your application if information is found to be false or misleading.

2. Use of Your Personal Information

• Your personal information will be collected, stored, used, and disclosed as set out in our Privacy Policy.

• By applying, you consent to Komforce contacting you regarding your application or other relevant career opportunities.

• Your information may be shared with our clients and third-party service providers involved in the recruitment process.

3. No Guarantee of Employment or Engagement

• Submitting an application does not guarantee you an interview, job offer, or engagement.

• Komforce is not responsible for any decisions made by clients or third parties regarding your employment or engagement.

4. No Employment Relationship with Komforce

• Unless explicitly stated otherwise, submitting an application does not create an employment relationship between you and Komforce.

• Any employment relationship will be directly between you and the client or, in rare cases, Komforce if hired internally.

5. Applicant’s Responsibility for Work Rights

• You are solely responsible for ensuring that you have the legal right to work in the relevant jurisdiction for any role you apply for.

• Komforce does not guarantee visa sponsorship or work permits unless specifically stated in the job advertisement.

6. Use of Recruitment Platforms

• Komforce is not responsible for any technical issues, interruptions, or data handling practices of third-party job boards or platforms through which you apply.

• You agree to comply with the terms of use and privacy policies of any such platforms.

7. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or misleading information.

• Use Komforce’s recruitment services for any unlawful or inappropriate purpose.

• Attempt to circumvent Komforce’s recruitment process or contact clients directly regarding advertised roles, unless otherwise permitted.

8. Candidate Representation Agreement (CRA) Notice

If you are shortlisted for a role, you may be asked to enter into a separate Candidate Representation Agreement (“CRA”) with Komforce. The CRA will govern the terms of our representation, including confidentiality, exclusivity, and other obligations. You will be given the opportunity to review the CRA before signing.

9. Limitation of Liability

To the extent permitted by law, Komforce excludes all liability for any loss, damage, or claim arising from your application or recruitment process, including any decisions made by clients or third parties.

10. Changes to Terms

Komforce reserves the right to update or amend these Terms at any time. The current version will be available on our career page and will apply to all new applications.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
